Saddle Sense Terms of Use

1. About These Terms

These Terms of Use (“Terms”) are a legal agreement between you and VIRIDIAN LABS LTD, a company registered in England and Wales under company number 16619547, whose registered office is at West Goods Entrance, Somerset House, Victoria Embankment, London WC2R 1LA (“Viridian Labs”, “we”, or “us”). Saddle Sense is the air quality sensing app and platform that we operate.

These Terms govern your use of the Saddle Sense app, sensor hardware, pollution maps, API, and all related services (together, the “Service”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use the Service.

These Terms apply to all users of the Service, including participants in council-sponsored pilot programmes (see Section 4).

2. The Service

2.1 What Saddle Sense Does

Saddle Sense is a crowdsourced pollution mapping platform. The Service provides:

• Personal ride history and exposure tracking: your trips, routes, and estimated pollution exposure, visible only to you.
• Pollution-aware route suggestions: helping you find cleaner routes based on current and modelled air quality data.
• A live air quality map: built from anonymised, aggregated data contributed by Saddle Sense sensor users, combined with modelled data and reference station readings.

If you use a Saddle Sense air quality sensor, it connects to the app via Bluetooth and measures PM1, PM2.5, and PM10 concentrations, temperature, humidity, and atmospheric pressure along your route. Section 2.6 explains the different ways you can access the Service.

2.2 How the Map Works

The pollution map is built from the anonymised contributions of many Saddle Sense users, combined with readings from fixed reference monitoring stations and other data sources. Your individual readings are stripped of any link to your identity and combined with data from other riders and sources to produce modelled pollution estimates for road segments, not records of individual journeys.

We build the map to obscure individual journeys. Because each segment estimate reflects contributions from multiple riders blended with other sources, the published map does not reveal any individual user’s route, timing, or identity, and is built to prevent their reconstruction from the published data.

2.3 Map Data Availability

We make the anonymised, aggregated map data available to council and government partners, academic researchers, commercial API customers, and the public. This is described in Section 6.1 of our Privacy Policy. The map data does not contain personal data.

2.4 Nature of the Data

The air quality data displayed in the app and published via our maps and API represents modelled estimates, not reference-grade measurements. Pollution levels are derived from a combination of crowdsourced sensor readings, atmospheric modelling, and reference station data. Actual pollution levels at any given location and time may differ from the estimates shown. See Section 9 for important limitations.

2.5 App Distribution and Platform Terms

During the beta and pilot phase, the app is distributed via Apple TestFlight. In general release it may be distributed through the Apple App Store, Google Play, or similar platforms. Your use of those platforms is also subject to their own terms and policies, which we do not control and are not responsible for.

2.6 Ways to Access the Service

You may access the Service in different ways, including:

• As a pilot participant, using a sensor loaned to you by Viridian Labs (see Section 4.1).
• By purchasing a Saddle Sense sensor or taking out a sensor subscription (see Section 4.2).
• By subscribing to the Service without a sensor, for access to the pollution maps, route suggestions, and exposure tracking.
• Through an organisation that provides access to you, for example a council or business that licenses the Service for its residents, members, or staff, or that runs a pilot with us.

The features available to you, and any fees, depend on how you access the Service. The sensor terms in Section 4 apply only if you have a sensor. Fees and payment are described in Section 8.

3. Your Account

3.1 Eligibility

You must be at least 18 years old to create an account and use the Service. The Service is intended for adults; we do not knowingly allow under-18s to create accounts.

3.2 Account Responsibilities

You are responsible for keeping your login credentials secure. You must not share your account with others. You are responsible for all activity under your account. If you believe your account has been compromised, contact us immediately at support@saddlesense.co.

3.3 Accuracy of Information

You agree to provide accurate information when creating your account and to keep it up to date.

4. Sensor Hardware

4.1 Pilot Sensors on Loan

If you take part in a council-sponsored pilot, your sensor is provided on loan by Viridian Labs for the duration of the pilot and remains our property at all times. While you have the sensor, you agree to take reasonable care of it, use it only for bike-mounted air quality measurement, not open or tamper with it, and return it in working condition at the end of the pilot by the date and method we tell you.

Participation in a pilot is also governed by a separate pilot agreement, which sets out the full pilot terms, including who is responsible for any loss of or damage to the sensor. You will not be charged by Viridian Labs for fair wear and tear, or for loss or damage that occurs through no fault of your own during the pilot.

4.2 Purchased and Subscribed Sensors

Outside of pilot programmes, sensors may be available for purchase or under a subscription or hardware-as-a-service arrangement. The specific terms governing sensor ownership, warranty, returns, and any fees will be set out in the applicable purchase or subscription agreement.

4.3 Sensor Care (All Users)

Regardless of how you obtained your sensor:

• Use the sensor only as described in the user guide and app instructions.
• Do not expose the sensor to conditions outside its operating specifications, for example submersion in water or extreme heat.
• Do not attempt to modify, reverse-engineer, or extract firmware from the sensor.
• Install firmware updates when prompted by the app.

4.4 Patent Notice

The Saddle Sense sensor (Sensor v3.0) is the subject of a pending patent application. Unauthorised reproduction, modification, or reverse-engineering of the sensor hardware or firmware may constitute patent infringement.

5. Your Data and Map Contributions

5.1 Your Personal Data

Your personal trip data (ride history, routes, personal exposure summaries) belongs to you. You can view, export, and delete it as described in Section 8 of our Privacy Policy. We process your personal data in accordance with our Privacy Policy.

5.2 Map Contributions and Sensor Use

Saddle Sense is a crowdsourced platform. If you use a Saddle Sense sensor, contributing anonymised, aggregated sensor data to the collective pollution map is a core part of the Service, not an optional add-on. By using the Service with a sensor, you agree to this contribution as part of your contract with us.

When you ride with your sensor connected, your air quality readings and GPS data are anonymised (mapped to road segments and stripped of identifying information) and aggregated with data from other users and sources to build and improve our pollution maps.

This is consistent with Section 3.2 of our Privacy Policy, which explains the contractual basis for this processing.

If you do not wish to contribute data to the pollution maps, you may stop using the sensor and request deletion of your personal data (see Section 10 of these Terms and Section 8 of the Privacy Policy). Anonymised data that has already been incorporated into aggregated maps cannot be removed, as it is no longer personal data.

5.3 Ownership of Aggregated and Anonymised Data

All anonymised and aggregated data, pollution maps, modelled outputs, algorithms, calibration data, and derivative works produced by the Service are owned by Viridian Labs. This includes the collective map data, API outputs, and any analytics or models derived from aggregated user contributions.

You do not retain any ownership interest in the anonymised, aggregated data derived from your contributions, because by definition that data is no longer personal data and cannot be attributed to you.

5.4 Permission to Use Your Data

You keep ownership of your personal data. To run and improve the Service, you give Viridian Labs permission to collect, process, store, and anonymise the sensor and location data generated through your use of the Service, for the purposes set out in our Privacy Policy (providing the Service, building and improving our pollution maps, and model training and calibration), and for no purpose that goes beyond it. We process this data in line with UK data protection law.

Once your data has been anonymised and aggregated, it is no longer personal data. As set out in Section 5.3, we own that anonymised and aggregated data and the maps, models, and other outputs derived from it, and we may use, retain, publish, and license them without restriction and without further obligation to you.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Tamper with, modify, reverse-engineer, or disassemble the sensor hardware or firmware.
• Attempt to reverse-engineer the anonymisation process or re-identify individual users from the aggregated map data or API outputs.
• Use data obtained from the Service (including via the API) to attempt to identify, track, or profile individual users.
• Scrape, harvest, or systematically download data from the Service, except through our official API and under the separate terms that govern API access.
• Interfere with or disrupt the Service, its servers, or its networks.
• Introduce malicious code or false sensor data, or otherwise attempt to corrupt the data or maps.
• Impersonate another person or misrepresent your affiliation.
• Use the Service in a way that could endanger yourself or others, for example interacting with the app while cycling in a way that distracts from safe riding.

7. Intellectual Property

7.1 Our Property

The Saddle Sense app, sensor hardware and firmware, algorithms, models, anonymised and aggregated map data, API, website, branding, and all related intellectual property are owned by Viridian Labs or its licensors. Saddle Sense and the Saddle Sense logo are trademarks of Viridian Labs. These Terms do not grant you any ownership rights in the Service.

7.2 Your Licence to Use the Service

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial purposes in accordance with these Terms. This includes using the app to view your ride history, receive route suggestions, and view the pollution map.

7.3 Your Personal Data

You retain ownership of your personal data (ride history, routes, exposure summaries) as described in Section 5.1.

7.4 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free licence to use that feedback for any purpose without obligation to you.

8. Fees

The Saddle Sense app is currently free to use for sensor users, including pilot participants.

Access to the platform without a sensor (the pollution maps, route suggestions, and exposure tracking) is available on a paid basis: by individual subscription, or through an organisation that licenses the Service for its residents, members, or staff, such as a council or a business. The fees, billing, renewal, and cancellation terms for any subscription or licence are set out in the applicable agreement, which you or that organisation enter into separately.

Where an organisation provides your access, any fees are arranged between us and that organisation, and your own use of the Service remains subject to these Terms.

We will always make clear what a paid option costs before you commit to it, and you will only be charged if you choose to subscribe or pay.

9. Disclaimers and Limitations

9.1 No Medical or Safety Advice

The Service is for informational purposes only. The air quality data, pollution maps, route suggestions, and exposure estimates provided by the Service do not constitute medical advice, health advice, or safety advice. You should not rely on the Service as the sole basis for decisions about your health, route choices, or physical activity.

If you have a respiratory condition or other health concern related to air quality, consult a qualified medical professional. The Service is not a substitute for professional medical advice.

9.2 Data Accuracy

Air quality measurements from the Saddle Sense sensor are estimates derived from consumer-grade hardware. They are not equivalent to reference-grade monitoring stations operated by statutory bodies such as DEFRA or the Environment Agency. Readings may be affected by sensor placement, calibration, environmental conditions, and other factors.

The pollution maps combine sensor data with atmospheric modelling and reference station readings. While we work to make the maps as accurate as possible, actual pollution levels may differ from the estimates shown. We do not guarantee the accuracy, completeness, or timeliness of any data provided through the Service.

9.3 Service Availability

We aim to keep the Service available but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, updates, technical issues, or factors beyond our control. Because the Service is currently in a pilot and beta phase, interruptions, errors, and changes may be more frequent.

9.4 Disclaimer of Warranties

We provide the Service “as is” and “as available.” This means that, as far as the law allows, we do not guarantee that the Service will be error-free or uninterrupted, or that the air quality data and routes will be accurate or fit for any particular purpose. Some protections are built into UK consumer law and cannot be excluded; nothing in these Terms affects those rights.

9.5 Limitation of Liability

To the maximum extent permitted by applicable law:

• Viridian Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to health effects, personal injury, property damage, lost data, or loss of profits.
• Viridian Labs shall not be liable for any decisions you make based on data provided by the Service, including route choices, exposure to pollution, or health-related decisions.
• If we are found liable to you despite the above, the most we will have to pay you in total for all claims is the greater of: (a) anything you have paid us in the 12 months before the claim, or (b) £50.

9.6 What We Do Not Exclude

Nothing in these Terms excludes or limits our liability for:

• Death or personal injury caused by our negligence.
• Fraud or fraudulent misrepresentation.
• Any other liability that cannot be excluded or limited by applicable law.

10. Termination

10.1 Termination by You

You may stop using the Service at any time, and you can delete your account directly in the app. When you delete your account, we remove your personal data from our live systems without undue delay, and from our backups within 90 days, as our routine backups are overwritten on their normal schedule, in line with Section 7 of the Privacy Policy. Anonymised data already incorporated into our maps is retained, as it is no longer personal data. You can also exercise your other data rights, including erasure, as described in Section 8 of the Privacy Policy.

10.2 Termination by Us

We may suspend or terminate your account at any time if:

• You breach these Terms.
• We are required to do so by law.
• We discontinue the Service or any part of it.

Where reasonably possible, we will give you advance notice of termination and an opportunity to export your personal data. In cases of serious breach, for example data tampering or attempts to re-identify users, we may terminate your account immediately without notice.

10.3 Pilot Programme Termination

If you are participating in a pilot programme, your access to the Service may also end when the pilot concludes. We will notify you in advance and give you the option to continue using the Service (subject to availability of a sensor or a subscription) or to delete your account and data.

10.4 Effect of Termination

On termination, your licence to use the Service ends. Sections that by their nature should survive termination will survive, including: Sections 5.3 and 5.4 (data ownership and permissions), Section 7 (intellectual property), Section 9 (disclaimers and limitations), and Section 12 (governing law).

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email at least 30 days before the changes take effect.

Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree to the updated Terms, you should stop using the Service and delete your account.

12. Governing Law and Disputes

These Terms, and any dispute arising from them or from your use of the Service, are governed by the laws of England and Wales and subject to the exclusive jurisdiction of the courts of England and Wales. The Service is intended for use in the United Kingdom.

13. General

13.1 Entire Agreement

These Terms, together with our Privacy Policy and any applicable sensor purchase or subscription agreement, constitute the entire agreement between you and Viridian Labs regarding the Service.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

13.3 No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

13.4 Assignment

You may not assign or transfer your rights under these Terms. We may assign our rights and obligations to a successor entity in connection with a merger, acquisition, or sale of assets, subject to the protections described in Section 6.2 of the Privacy Policy.
